Google Helped Catch a Sex Offender. Why That May Be Bad News for the Rest of Us

As Robert Gellman, a privacy and information policy consultant said, “No one defends child porn, but the principle that an email provider will read mail looking for criminal activities is problematic. It raises concerns over what standards apply and which crimes are included.”

The U.S. Postal Service is not allowed to open first class letters of its patrons. Why, then, should Google be treated differently? Each has a responsibility to provide a reasonable expectation to privacy to its customers.

U.S. judge OKs warrant for Google user’s emails, stoking debate

A federal judge in New York has granted prosecutors access to a Gmail user’s emails as part of a criminal probe, a decision that could fan the debate over how aggressively the government may pursue data if doing so may invade people’s privacy.

U.S. Magistrate Judge Gabriel Gorenstein said Friday he had authorized a warrant to be served on Google Inc for the emails of an unnamed individual who is the target of a money laundering investigation.

Gorenstein said his decision ran counter to several other judges’ rulings in similar cases that sweeping warrants give the government improper access to too many emails, not just relevant ones.

But he said the law lets investigators review broad swaths of documents to decide which are covered by warrants.

Google did not respond to a request for comment.

Waiver of Attorney-Client Privilege Via Facebook!

Breaches of confidentiality via Facebook and other social media are more common than most of us would like to think.  Employees post information about customers, clients, and patients on Facebook, in violation of internal company policies and privacy laws, such as HIPAA, for example. Recently, a plaintiff could not collect a sizeable settlement payment because his daughter posted about the settlement on Facebook, which served to demonstrate that her father had breached the confidentiality provision in the settlement agreement.

Ohio mayor is planning to ban hiring of smokers

Happy 4th of July! Home of the free*

*Restrictions apply!

Check out this story of what an Ohio Mayor would like to implement as a city wide hiring practice. You smoke? No job…

Outside of the health argument that goes with smoking tobacco, the legal issue here is discriminating against a group of citizens engaging in lawful activity.

Banning smokers has become common in the health-care industry and is spreading to governmental employment.

Dad Charged With Child Endangerment After 8 year old Son Plays Hookie from Church

The father of an 8-year-old boy in Blanchester, Ohio, will appear in court next week to face charges of child endangerment after his son skipped church to go play.

The boy’s father, Jeffrey K. Williamson Jr., 31, says he thought his son, Justin, had boarded a bus — along with his other children — sent by the Woodville Baptist Church. In reality, the boy apparently decided to play on his own, ditching his four siblings and walking to a nearby Family Dollar store instead.
